Supreme Court Highlights Bail Grounds for Accused
• The Supreme Court of India has ruled that an accused’s sickness and infirmity can be grounds for bail under the Prevention of Money Laundering Act, 2002 (PMLA).
• The three-judge Bench, led by Chief Justice D.Y. Chandrachud, allowed interim bail to Amar Sadhuram Mulchandani, former chairperson of Seva Vikas Co-operative Bank.
• The proviso to Section 45(1) of the PMLA allows for bail if the Special Court directs.
• The court also allows for exemptions for persons under 16, women, and the sick or infirm.
• In the current case, Mulchandani, 67 years old, was granted bail due to worsening cardiac function.
