Bombay High Court Upholds Sexual Intercourse with Minor Wife as Rape

• Bombay High Court affirmed that sexual intercourse with a minor wife, whether consensual or not, constitutes rape.

• Single Judge of Nagpur Bench, Govind A. Sanap, ruled that ‘consensual intercourse with wife’ cannot be accepted under the law.

• The court upheld a 10-year sentence on a 24-year-old man, convicted under the Protection of Children from Sexual Offences (POCSO) Act and the Indian Penal Code.
