Sri Lankan Refugees Eligible for Long-Term Visa (LTV) in India

• The Immigration and Foreigners (Exemption) Order, 2025, was notified by the MHA, exempting registered Sri Lankan Tamil nationals who took shelter in India up to January 9, 2015, from the provisions of the 2025 Act.

• The order also exempted undocumented members of six minority communities from penal provisions and possible deportation if they entered India without passports or visas, or with expired travel documents, before December 31, 2024.

• Sri Lankan Tamils will not be eligible for LTVs.

• Other eligible categories include Pakistani and Bangladeshi women married to Indians, Afghan nationals married to Indians in India and staying in India, Indian origin women holding Pakistan/Bangladesh/ Afghanistan nationality married there, who wish to return to India due to widowhood/divorce, and cases involving extreme compassion.

• An advisory committee recommended issuance of stay/LTV to Sri Lankan Tamils to become eligible to apply for citizenship.

• Antony Arulraj, an activist, praised the MHA’s leniency in setting January 9, 2015 as the cut-off date, stating it makes India a safe haven for Sri Lankan Tamils who took refuge before 2015.
