Supreme Court Upholds Aadhaar as Right-to-Vote Statute

• The Supreme Court of India (SC) has ruled that Aadhaar is part of the right-to-vote statute and can be used by voters.

• The court responded to submissions that Aadhaar is inferior to the 11 documents listed by the Election Commission for voter verification during the special intensive revision of Bihar electoral rolls.

• Petitioner-advocate Ashwini Kumar Upadhyay argued that Aadhaar is merely a “simple” proof of identity.

• Justice Bagchi questioned if Aadhaar is not part of the statute governing the EC regarding the right to vote and inclusion on the rolls.

• The court issued notice on Upadhyay’s plea and fixed October 7 to hear arguments on the legality of the special intensive revision.
