Tamil Nadu Governor R.N. Ravi’s New Rules and Supreme Court’s Interpretation

• Tamil Nadu Governor R.N. Ravi is addressing Supreme Court’s interpretation of a Presidential reference made in May 2025.

• The Supreme Court’s April 2025 judgment specified timelines for Governors and the President to act on State Bills.

• The court prescribed a three-month timeline for the President to decide on State Bills reserved for his consideration.

• The government questions the court’s authority to prescribe timelines when they are not specified in the Constitution.

• Article 200 of the Constitution outlines four alternatives for a Bill presented to the Governor for his/her assent: giving assent, withholding assent, returning the Bill for reconsideration, or reserving the Bill for consideration of the President.

• Opposition-ruled States argue that Governors have been selectively delaying assent or reserving Bills against the advice of the Council of Ministers.

• The Constitution does not lay down any time limit within which the Governor is required to make a decision with respect to any Bill presented for his/her assent.

• The politicisation of the gubernatorial post has led to calls for the abolition of the Governor’s post.

• The Supreme Court has interpreted the words in Article 200 in its April 2025 judgment as not a discretionary power.
