HC refuses to stop the GR conferring Kunbi status to Marathas

• The Bombay High Court rejected a stay on the Maharashtra government’s decision to grant Kunbi caste certificates to certain Maratha community members.

• The court, consisting of Chief Justice Shree Chandrashekhar and Justice Gautam Ankhad, heard petitions from various OBC groups, including the Kunbi Sena and Maharashtra Mali Samaj Mahasangh, who argued that this could lead to Marathas being classified under the OBC category, impacting existing reservation rights.

• Petitioners requested interim relief against the government’s September 2 resolution, which permits eligible Marathas to acquire Kunbi certificates based on historical records.

• The court declined to comment on the case’s merits, allowing four weeks for the State to respond, and stated that it would not provide interim relief at this time.

• Advocate General Birendra Saraf contended that the petitioners were not directly impacted by the resolution and thus had no standing to challenge it.

• The resolution followed a five-day protest by Maratha activist Manoj Jarange-Patil, advocating for recognition of Kunbi ancestry among Marathas for OBC inclusion.
