India’s Refugee Policy: Non-Discrimination and Infiltrators

• Union Home Minister Amit Shah emphasizes the need to distinguish between refugees and infiltrators.

• The issue lies in the application of objective parameters by those in power to distinguish.

• India lacks a comprehensive single law defining who a refugee is, leading to arbitrary action.

• The Immigration and Foreigners Act replaced three pre-Independence laws, subsuming the Immigration (Carriers’ Liability) Act, 2000.

• The absence of a refugee policy document has led to different yardsticks for the refugee community.

• Undocumented or overstaying refugees are regarded as illegal migrant or infiltrator, risking harassment.

• The Citizenship (Amendment) Act, 2019 discriminated on the lines of religion, leaving out sections of Muslims, Sri Lankan Tamils, and the Rohingya.

• Undocumented or overstaying Tamil refugees were granted exemption from penal provisions of the Immigration and Foreigners Act, provided they took shelter in India on or before January 9, 2015.

• The trend of religion-based exclusions remains.

• Disclosed humanitarian relief to refugees should be backed by consistent, rational, and fair treatment for all.
