Union Ministry of Electronics and Information Technology to amend social media takedown rules

• The Union Ministry of Electronics and Information Technology (MeitY) plans to introduce new safeguards to social media takedown rules.

• The amendment will be introduced to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

• The new rules will increase the government’s accountability, with orders passed at senior levels such as Joint Secretary and Deputy Inspector-General at the State level.

• The safeguards specifically pertain to Rule 3(1)(d) of the IT Rules, allowing government officials to flag content that prevents social media firms from claiming “safe harbour” from legal liability.

• The amendment will force social media firms to defend content as publishers, not just intermediaries.

• The amendment will go into effect on November 15.
