Israeli Finance Minister Approves Settlement to ‘Bury’ Palestinian State

• The dispute revolves around the principle of natural justice, involving 65 lakh voters “deleted” from the draft electoral roll.

• The Constitutional right involved is the entitlement to remain on the constituency’s electoral roll.

• The Supreme Court Bench of Justices have repeatedly asked whether the challenge to the SIR is about the legality of its procedure or the very power of the Election Commission (EC).

• Petitioners argue that the procedure, including excluding existing electors until they bring proof of their citizenship, and the en bloc deletion of lakhs of voters without a prior enquiry by the Election Registration Officer (ERO), is a “casual” exercise of the EC’s considerable power to control the electoral roll under Article 324 of the Constitution.

• Statutory laws guide the EC on the registration of names on the electoral rolls, balancing the EC’s power of superintendence over elections with the ordinary citizens’ or the “little man’s” right to vote.

• The Supreme Court divided electors into two categories — first-time electors and existing electors.

• The Bihar draft roll has deleted voters who had participated in multiple elections over the past 22 years.

• The burden is now on the electors to prove their citizenship to the EC with just two months left for the Assembly election.
