    No ban on posthumous fatherhood: Delhi High Court

    • The Delhi High Court has ordered a hospital to release frozen sperm from an unmarried deceased man to his parents.
    • The court ruled that posthumous reproduction is not prohibited under Indian law if the consent of a sperm or egg owner is proven.
    • Justice Prathiba M. Singh stated that the deceased’s son had given consent for the preservation of his semen sample to preserve fertility.
    • The court emphasized that grandparents are equally capable of integrating their grandchildren into society.
    • The court cited cases from Israel, Germany, and Germany, where parents and the mother of the deceased soldier were allowed to access their son’s sperm sample posthumously.
