    Rules allow Muslim women to sue bigamous husbands.

    • A Muslim woman can claim damages from her husband for inflicting mental harm under the Protection of Women from Domestic Violence Act of 2005.
    • Justice G.R. Swaminathan ruled that a Muslim woman must seek a judicial declaration if she disputes the validity of her estranged husband’s triple talaq (divorce).
    • Swaminathan ruled that Shariat councils of no Jamath can deliver divorce judgments, stating only state-constituted courts can do so.
    • The case involved a doctor couple who married in 2010 and had a son.
