Sedition Law Violates Free Expression and SC Guidelines in Assam

• The Assam police have summoned journalist Siddharth Varadarajan for sedition over an article on Operation Sindoor.

• The article, which included comments by India’s military attache to Indonesia, was deemed an act “endangering India’s sovereignty, unity, and integrity.”

• The Supreme Court directed the Assam police to refrain from “coercive steps” against Varadarajan, but in defiance, the police registered a second FIR in a different district.

• The Supreme Court’s landmark Kedar Nath Singh judgment (1962) clarified that criticism of the government is not sedition unless it directly incites violence or fosters public disorder.

• The government requested an opportunity to repeal the law before it was struck down, but the law on sedition was retained with a change in nomenclature in 2023.

• Former CJI DY Chandrachud warned that the law’s misuse could stifle free expression and the right of journalists to ensure an informed society.
