Simultaneous Election Bill Grants Election Commission (EC) Unbridled Powers
• Two former Chief Justices of India, D.Y. Chandrachud and J.S. Khehar, argued that the Bill does not violate the Basic Structure of the Constitution.
• They pointed out that the laws have not prescribed any oversight mechanism to check the EC’s powers.
• Justice Khehar suggested that Parliament or the Union Council of Ministers should have a say in taking the call on holding the election to an Assembly.
