Supreme Court hears Kerala doctor’s petition on ‘brain-stem death

• The Supreme Court ruled that a law determining the point of human death, after which organs and tissues can be transplanted, is not an ‘unlawful intrusion’ into the fundamental right to life.

• The court, comprising Justices Surya Kant and Joymalya Bagchi, ruled that the definition of ‘brain-stem death’ in the Transplantation of Human Organs and Tissues Act of 1994 is not a violation of Article 21 (right to life) of the Constitution.

• The court deferred the hearing in the case, citing that harvested organs were transplanted into incompatible recipients, leading to a high failure rate.
