  • Supreme Court Judge Advocates for Decriminalization of Defamation

    • Justice M.M. Sundresh, a Supreme Court judge, expressed concern over the increasing use of criminal defamation law by private individuals and political parties.

    • Sundresh emphasized the need to “decriminalise” slurs, referring to the question of whether defamation by a private person can be treated as a crime.

    • The Supreme Court upheld the Constitutional validity of criminal defamation in 2016, stating it protects reputation and is a part of the fundamental right to life.

    • Sundresh’s comment came during a Bench hearing a petition filed by the Foundation for Independent Journalism and a journalist to quash summons in a criminal defamation case filed by former Jawarharlal University Professor Amita Singh.

    • The Supreme Court has previously stayed criminal defamation proceedings against Rahul Gandhi for his remarks against Union Home Minister Amit Shah and Congress MP Shashi Tharoor.

    • The court has previously ruled that words or acts claimed to be criminally defamatory must be judged from the standards of reasonable, strong-minded, firm and courageous men.
