Supreme Court Questions Union of India on Upward Mobility for Disabled Candidates

• The court urged the Union government to detail steps taken to ensure the upward movement of such candidates.

• The Union government was directed to respond by October 14.

• The judgment argues that candidates with disabilities are still restricted to seats or jobs allotted for the disabled category, instead of allowing upward mobility.

• The court argues that stagnation of a candidate with disabilities defeats the purpose of reservation under Section 34 of the Rights of Persons with Disabilities Act.

• The court emphasized that the government should see the larger objective of reservation as opening a window for people with disabilities to join the mainstream and share opportunities.
