Supreme Court Ruling on Waqf Law

• The Supreme Court ruled that the Waqf (Amendment) Act, 2025, is arbitrary and unconstitutional.

• The proviso to sub-section (2) of Section 3C of the 2025 Act denudes a Waqf property’s status when it’s alleged to be an encroachment on government property.

• The proviso does not provide any timelines or a reasonable period for the inquiry, leaving the Waqf property “high and dry”.

• Section 3C(3) empowers a government officer to determine the property’s title, which is a function of a competent court or tribunal.

• The proviso allows the officer to change the revenue records, altering the status of a Waqf property into a government asset.

• Section 3C(4) empowers the State government to instruct the State Waqf Board to delete the property from their records.

• The court found the process “unilateral” and violated the doctrine of separation of powers.

• The status of the Waqf property will remain intact until the dispute is finally decided.
