The Supreme Court has stayed the Lokpal order on the powers of the HC justices.
• The Lokpal, an anti-corruption body, has jurisdiction to investigate complaints about High Court judges in India.
• The High Courts in India were constituted by British Parliamentary Acts and Letters Patent of the British Monarch.
• The Lokpal argued that the Constitution did not establish the High Courts, while the Supreme Court was a child of the Constitution.
• The Lokpal declared that it had no power over Supreme Court judges, including the Chief Justice of India.
• The Lokpal found the argument that a High Court judge was outside the ombudsman’s jurisdiction “too naive”.
• The Lokpal stated that a High Court judge came within the ambit of clause (f) of Section 14(1) of the 2013 Act.
• The Supreme Court was notified of the Lokpal’s order and emphasized that all judges have been appointed under the Constitution.
