Tribal Affairs Ministry’s Confusion Over Great Nicobar Project Clearances

• The Tribal Affairs Ministry has been arguing that the implementation of the law falls within the Union Territory, causing confusion over the Great Nicobar project’s forest clearances.

• The Ministry has previously told the Calcutta High Court that it should be dropped from the list of respondents, arguing that the implementation of the law falls within the respective State or Union Territory.

• The Ministry has denied and disputed all assertions made in the petition, stating that the no-objection certificate issued by the Ministry in 2020 for the project, mandating FRA compliance, was given on the basis of facts given by the Andaman and Nicobar Administration.

• The Tribal Council for Little and Great Nicobar alleged that the certificate amounted to a “false” representation as the process for recognising and vesting rights under the FRA had not even been initiated on the Nicobar islands.

• The Environment Ministry has stated that land is a State subject and that the Ministry of Tribal Affairs is the nodal Ministry for the Forest Rights Act, 2006.
